Case Dismissed- Aggravated Assault Deadly Weapon

Valor Investigations received a case. Our client was charged with aggravated assault with a deadly weapon causing serious bodily injury. On the surface this case looked like exactly what our client was charged with. Investigator Betty Simons was lead on the case and quickly realized nothing was as it seemed. It’s easy for a prosecutor to look at the surface and charge a person based solely on a law enforcement officers opinion. The complainant had 3 gunshot wounds, one to the neck, one to the back left side and another to the middle back.

Our client did just as we advise all clients to do, and did not provide a statement to law enforcement officers. Once Investigator Simons began to dig into the true history of this case, she was able to obtain over 15 incidents of the complainant previously threatening our client with death and severe bodily injury as well as causing previous property damage.

He was even trespassed from our clients residence. On the evening in question the complainant showed up at the home of our client and assaulted him. Our client was in fear for his life, and in fear of seriously being injured. Our client defended himself and his family.

However the prosecution claimed that the location of the bullet wounds must mean he was not a threat to our client. By using her extensive knowledge in the way the brain reacts in high stress situations, proven scientific studies on reaction times, and recreating the scene investigator Betty Simons was able to prove through her detailed investigative report that our client acted in self defense and just because someone is shot in the back does not automatically mean the other party is guilty of a crime.

Betty along with the defense attorney were able to obtain a dismissal for our client.
